I was hired to provide expert testimony on behalf of a property management company that is being sued. The case involves a minor child opening the oven door (the oven was off) and standing on the oven door. While standing on the oven door he reached for a pot on the stove that included boiling water and then the stove feel forward knocking the water on minor child causing injuries. There were no brackets on the oven which would have prevented the oven from tipping forward. Home Depot installed the oven and did not install the fasteners. Also, there was a home inspection performed 3 months prior to the incident and they did not mention the fasteners were missing.
The main point I will be arguing the fact that it is not common nor the duty of a property management company to inspect for items such as fasteners on an oven.
I will provide the winning contractor with additional information. I have already prepared by brief and only want someone to write their own opinion so I can see if there are any subjects I might want to add to my version.
I will hire someone within 6 hours of my post and the job must be complete within 24 hours of hiring.
